Definitions

In these Conditions the following definitions shall apply:

• “Agreement” – the agreement between you and Runfest Limited comprised of the Event Conditions and these Conditions of Entry;

• “UK GDPR” – the UK General Data Protection Regulation;

• “Data Protection Legislation” – the UK GDPR and the Data Protection Act 2018;

• “Event” – the Hampton Court Half Marathon, Kingston Break-fest Run, Kingston Half Marathon and River Thames Half Marathon organised by Runfest Limited;

• “Event Conditions” – the terms and conditions, in addition to these Conditions of Entry, provided to you by Runfest Limited in respect of the Event from time to time;

• “Event Date” – the announced date of the Event;

• “Event Details” – the name, image and event time of each participant;

• “Fee” – the fee payable by you (or the charity from whom you obtained the entry) to Runfest Limited in consideration of your participation in the Event, as specified in the Event Conditions;

• “we”, “us”, “our”, “Hampton Court Half Marathon”, “Kingston Break-fest Run”, “Kingston Half Marathon”, and “River Thames Half Marathon” – means Runfest Limited;

• “Officials” – any event officials appointed by Runfest Limited from time to time;

• “Partners” – any sponsors, suppliers, licensees or partners of the Event from time to time;

• “Personal Data” – shall have the meaning given under the UK GDPR and the Data Protection Act 2018;

• “Privacy Policy” – Runfest Limited’s Privacy Policy, available on our website;

• “Rules” – the laws, rules and regulations of UK Athletics, England Athletics, World Athletics and any other relevant governing body;

• “you” / “your” – the entrant to the Event or, where you are signing as a parent or guardian for a child aged under 18 for whom you are responsible, your child.


1. ENTRY

a) By submitting your application you agree to enter the Event and agree to abide by these Conditions of Entry, the Event Conditions and any instructions given by the organisers and Officials of the Event.

b) Participants in the Event are subject to the Rules in force at the time of the Event. If there is any conflict between the Rules and the Agreement, the Agreement shall apply to the extent of the conflict.

c) Participants must be over the following ages on the Event Date for the race they are registered to participate in:

• 18 or over for the Marathon;

• 17 or over for the Half Marathon events;

• 15 or over for any 10K event.

d) Your Personal Data and images will be processed in accordance with the Runfest Limited Privacy Policy.

e) Race entries are non-transferable and non-deferrable unless expressly stated otherwise in these Conditions.

Participants may cancel and obtain a full refund within 14 days of purchase, provided the Event is not due to take place within that 14-day period and the entry has not already been used.

After this period, entry fees are non-refundable except where required by applicable consumer law or expressly provided for in these Conditions.

We reserve the right to permit transfers, deferrals or credits at our discretion in exceptional circumstances.


2. EVENT CHANGES, PUBLIC HEALTH AND PREGNANCY

2.1 Event Changes and Public Health

Runfest Limited will use reasonable endeavours to stage the Event as advertised. However, circumstances beyond our reasonable control may require us to amend, postpone, reschedule or cancel the Event.

Such circumstances may include (without limitation):

• public health risks or pandemics;

• government guidance, laws or restrictions;

• severe weather;

• safety concerns;

• terrorism or security threats;

• infrastructure failure; or

• any other circumstance that would make the Event unsafe, impracticable or commercially unviable to stage.

Where reasonably practicable, participants will be notified of any material changes in advance.

In the event of postponement, entries may be transferred to the rearranged Event date or another Runfest Limited event of equivalent value. Refunds will only be provided where required by applicable law.

2.2 Pregnancy Deferrals

We understand that pregnancy and postnatal recovery can affect your ability to participate in the Event.

If you become pregnant after entering one of our Events, we offer a one-year deferral to another Runfest Limited event of equivalent value.

Alternatively, where operationally possible, we may allow a transfer of your entry to another participant.

3. EVENT SAFETY

a) At all times during the Event you must adhere to all instructions given by Runfest Limited Event Officials.

b) Participation in the Event is personal to you. You are strictly prohibited from swapping, selling, transferring or offering to sell, swap or transfer your place in the Event or allowing any other person to wear your Event number.

c) Any breach of this Condition shall render the entry void. If you are found to be in breach of this Condition we reserve the right to exclude you from participation in future Events.

d) You are not permitted to use the following items in the Event:

• any motorised wheeled device;

• any artificial aid (excluding non-powered wheelchairs);

• any pets or animals; or

• any other item that could potentially inhibit the flow or safety of other participants or which we, acting reasonably, deem may cause danger or risk of danger to you, other participants or spectators.

e) You warrant that on the Event Date you will be sufficiently fit and healthy to participate in the Event unaided and in accordance with the Agreement. If you are in any doubt, we recommend that you seek medical advice before participating.


4. EVENT EJECTION

We reserve the right to refuse entry to the Event or require you to cease participation if:

  1. you fail to follow instructions given by Event Officials;
  2. you attempt to participate in the Event in a manner that we, acting reasonably, believe:

a) may cause injury to you or another participant;

b) may damage or harm the environment;

c) is likely to cause offence; or

d) creates a risk or potential risk to health and safety;

  1. in our reasonable opinion you are unfit to participate due to:

a) the consumption or use of alcohol or drugs;

b) injury or illness;

c) failure to arrive at the start location at the specified time; or

d) inability to make sufficient progress to complete the Event within timelines set by Event Officials.

  1. Competitors will only be eligible for a medal and inclusion in the official results if they complete the course within the official cut-off times.
  2. If you are refused entry or required to cease participation, you must remove and return your runner identification number and timing chip to an Event Official.
  3. Participants may have their results annulled and may be banned from future Runfest Limited events for a period of up to five years if they:

a) allow another person to use their race number;

b) participate using another participant’s race number;

c) use a counterfeit race number;

d) sell or transfer their race number;

e) falsify information on an entry form; or

f) otherwise breach these Conditions or the Rules.

  1. A second breach of any nature may result in a lifetime ban from all future Runfest Limited events. The decision of Runfest Limited shall be final.

5. CANCELLATION BY YOU

You should inform us as soon as reasonably possible if you need to withdraw from the Event.

Except where expressly stated otherwise in these Conditions or required by law, entry fees are non-refundable.

If you obtained a place through a charity, the place will revert to the charity.


6. CANCELLATION BY US

We may cancel, postpone or amend the Event if circumstances beyond our reasonable control arise, including but not limited to war, civil unrest, terrorism, severe weather, public health concerns or safety issues.

We may also cancel your entry if you obtained it through a third party (such as a club, sponsor or charity) who is no longer entitled to that entry.

In such circumstances:

a) we will, where reasonably practicable, provide notice using the contact details held for you; and

b) where advance written notice is impracticable, we will use reasonable endeavours to provide notice through other suitable channels including email, SMS, website updates, social media, television or radio broadcasts.

Except where required by law, Runfest Limited shall not be responsible for any costs incurred by participants as a result of cancellation, postponement or amendment of the Event, including travel, accommodation or other incidental expenses.


7. DATA PROTECTION AND MARKETING

Please read our Privacy Policy carefully to understand how Runfest Limited collects, uses and protects your Personal Data.

By entering the Event, you acknowledge that your Personal Data will be processed in accordance with our Privacy Policy and applicable Data Protection Legislation.

For the purposes of this Condition 7, Personal Data may include medical or health information provided for Event safety purposes.

We may use your Personal Data for purposes connected with:

• administering and operating the Event;

• participant safety and medical assistance;

• compiling anonymised statistics;

• publishing Event results; and

• fulfilling legal and regulatory obligations.

We may share relevant Personal Data with:

• Event Officials and medical providers;

• governing bodies;

• timing and results providers; and

• Event partners and service providers acting on our behalf.

Marketing communications will only be sent where permitted under applicable law. You may opt out of marketing communications at any time by using the unsubscribe link in communications or by contacting us directly.

Any audio, visual or audio-visual recordings made by participants at the Event are for personal, non-commercial use only.


8. CHANGES TO THE EVENT

8.1 We reserve the right to change the Event course, distance, format, schedule or any other aspect of the Event where reasonably necessary for safety, operational, regulatory or logistical reasons.

8.2 Any material changes will be communicated to participants as soon as reasonably practicable.

8.3 If the Event route, distance, format or schedule is amended, the Event shall still be deemed to have been staged and refunds will not normally be provided except where required by applicable law.


9. USE OF IMAGE AND MEDIA

The Event may be photographed, filmed, broadcast and otherwise recorded.

By participating in the Event, you acknowledge that your image, likeness, voice and participation may appear in photographs, video recordings, livestreams, broadcasts, social media content and promotional materials relating to the Event.

You grant Runfest Limited and parties authorised by Runfest Limited the right to use such materials worldwide and in perpetuity for legitimate promotional, editorial, commercial and archival purposes without compensation.

Any recordings or photographs taken by participants or spectators are for personal, non-commercial use only unless prior written consent has been obtained from Runfest Limited.


10. LIABILITY

Participation in the Event is at your own risk.

Nothing in these Conditions excludes or limits liability for:

• death or personal injury caused by negligence;

• fraud or fraudulent misrepresentation; or

• any other liability which cannot legally be excluded or limited.

Subject to the above, Runfest Limited shall not be liable for:

• loss of profit;

• loss of business or revenue;

• loss of reputation;

• loss of anticipated savings;

• indirect or consequential loss; or

• costs incurred in connection with travel, accommodation or third-party arrangements relating to the Event.

Nothing in these Conditions affects your statutory rights under applicable consumer law.


11. GENERAL

a) If there is a conflict or inconsistency between these Conditions of Entry and any Event Conditions, the Event Conditions shall prevail to the extent of the conflict or inconsistency unless expressly stated otherwise.

b) The Agreement shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.

c) If any provision of the Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall continue in full force and effect.

d) The Agreement does not create or confer any rights enforceable by any person who is not a party to it.

e) You agree that we may publish limited Personal Data as part of Event results, including your name, club affiliation, race times, nationality and age category where relevant for event administration, rankings, permits, insurance or results publication purposes.


12. GENDER INCLUSIVITY

Runfest Limited is committed to creating an inclusive, welcoming and respectful environment for all participants.

We recognise that some participants may not identify within binary gender categories and we aim to provide inclusive registration options wherever reasonably possible.

However, our Events are conducted under the rules and regulations of UK Athletics and other applicable governing bodies, which may determine how competitive categories, results and prize eligibility are administered.

At the time of writing, official rankings, results uploads and certain competitive categories recognised by governing bodies may require participants to be recorded within categories defined by those governing bodies.

We will continue to review our policies and procedures in line with developments in governing body guidance and best practice relating to inclusion in sport.
